Terms of service
Last updated: 23 September 2026
YOUR USE OF THE SERVICES IS SUBJECT TO BINDING BILATERAL ARBITRATION OF ANY DISPUTES WHICH MAY ARISE, INCLUDING THE JAMS MASS ARBITRATION PROCEDURES AND GUIDELINES WHERE APPLICABLE, AS PROVIDED BELOW IN SECTION 17 AND IN THESE TERMS OF USE. PLEASE READ THE ARBITRATION PROVISIONS CAREFULLY AND DO NOT USE THE SERVICES IF YOU ARE UNWILLING TO ARBITRATE ANY DISPUTES YOU MAY HAVE WITH US AS PROVIDED BELOW.
These Terms of Use (“Terms”) apply to your access to, and use of, the services of Margot Vane (“Margot Vane”, “us”, “our” or “we”), including without limitation by visiting the website available at https://margotvane.com (the “Website”), purchasing products from us, or engaging in any other activity that links to these Terms (collectively, the “Services”). These Terms do not alter any other written agreement you may have with us that expressly governs its subject matter. If you are using the Services on behalf of an entity, you represent that you are authorised to accept these Terms on its behalf.
Please read them. By using the Services you agree to be bound by them, together with our Privacy Policy, Refund Policy and Shipping Policy, each of which is part of this agreement. If you do not agree, please do not use the Services.
1. Changes to these Terms
We may update these Terms from time to time. Changes apply going forward, not backward: an order you have already placed is governed by the Terms in force when you placed it. We will post the revised Terms here and update the “last updated” date shown at the top and foot of this page. Continuing to use the Services after a change means you accept it.
2. Eligibility
You must be at least 18, and you confirm you are at least the age of majority where you live. If you do not meet that, please do not use the Services.
We do not knowingly collect personal information from children under 13. If we learn that we have, we will delete it. If you believe a child under 13 has given us information, email care@margotvane.com with “Minor data” in the subject line and we will deal with it.
If you are buying on behalf of a business, you confirm you are authorised to bind it.
3. Your account
You do not need an account to browse, but you may create one. Keep your login details to yourself; you are responsible for activity under your account, and for keeping the billing and contact details on it current and accurate. Tell us at care@margotvane.com if you think someone else has access to it.
We may limit or close an account that is used in breach of these Terms.
4. Acceptable use
Use the Services lawfully and in good faith. Do not, and do not help or encourage anyone else to:
- interfere with the site's security, or try to access accounts, data or systems you are not authorised to reach;
- probe or scan the site for vulnerabilities;
- upload malware or anything designed to damage, disable or overburden the Services;
- scrape, harvest or extract data by automated means without our written permission;
- remove copyright, trademark or other proprietary notices from anything you take from the site;
- misrepresent who you are, your age, or any connection to us;
- resell our products as new, or use the Services to infringe anyone's rights.
We may suspend or refuse access to anyone who does.
5. Content you send us
If you send us reviews, photographs, design references or other material, you keep ownership of it. You grant us a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, use, reproduce, adapt, publish and display it in connection with running and promoting the Services — including in advertising on third-party platforms. That licence lasts while the material is protected by intellectual property rights, or until you delete it, subject to reasonable backups and any retention the law requires. Where the law allows, you waive moral rights in it.
You confirm the material is yours to give and infringes nobody's rights. Do not send anything unlawful, defamatory, harassing, obscene, fraudulent, misleading, impersonating, spam, or containing malware.
We may decline to publish or remove any submission, but we are not obliged to monitor. Ideas and suggestions you send us are voluntary and non-confidential, and we may use them without payment.
6. Our content
The site and everything in it — text, photography, product and CAD designs, the data compilations behind our diamond listings, and the Margot Vane name and marks — are owned by us or licensed to us, and protected by intellectual-property law.
You may view and print pages for your own personal, non-commercial use. Anything else needs our written permission: copying or republishing, using our images or product descriptions elsewhere, data extraction or mining, or using our listings to train a model or build a competing catalogue.
You may not use our name or marks without permission, in a way likely to cause confusion, or in a way that disparages us.
If you believe material on the site infringes your copyright, email care@margotvane.com with a description of the work, where the material appears, a statement that you believe the use is unauthorised, and your name and contact details. We may remove material at our discretion without accepting that it infringes.
7. Products, descriptions and pricing
Every piece is handcrafted to order and polished by hand rather than by machine, so pieces carry small individual characteristics. These are a feature of handmade work, not defects.
We describe our diamonds using the grading report supplied with each stone by IGI, GIA or GCAL, and publish measurements drawn from those reports. Grading is the opinion of the issuing laboratory, and laboratories can differ. Photographs and 360° imagery are representative; screens vary, and a stone in person will not match a screen exactly.
Prices are in US dollars and may change at any time, and we may discontinue a product or change the Services without notice. Every sale is based on the price agreed when you ordered.
We do not guarantee the resale value, appraisal result or future market value of any piece. Lab-grown diamond prices move, and a valuation obtained elsewhere may differ from what you paid.
If a price or product description is wrong, we may cancel or decline the order — including after a confirmation — and refund you in full. We are not obliged to sell at an incorrect price.
8. Orders
Your order is an offer to buy. It is accepted when we confirm it by email, and we may refuse, cancel or limit any order — including where we cannot verify payment or address details, where fraud is suspected, or where an order appears to be from a reseller rather than for personal use.
Payment is taken through our payment providers; we do not store your full card details. You agree to keep your billing details accurate. Fraudulent chargebacks may result in account limitations and recovery of our related costs, as far as the law allows. Where payment plans are offered by a third party, that provider's terms govern, and any dispute about the financing is between you and them.
Production and delivery times are estimates, not guarantees. Delays can happen in manufacturing, quality control, certification, shipping or customs. We are not liable for a missed personal deadline or occasion, so please order with time to spare and tell us if a date matters — we will say honestly whether it is achievable.
Because pieces are made to order, production starts shortly after confirmation. If you need to change or cancel, contact care@margotvane.com as soon as possible; once production has started, changes and cancellations are treated as returns under our Refund Policy.
9. Returns and refunds
Our Refund Policy forms part of these Terms and sets out the detail. In summary: qualifying jewellery may be returned for a full refund within 30 days of the ship date, domestic US returns include a complimentary insured prepaid label, and refunds are processed within 10–14 business days of inspection.
Some items are final sale and cannot be returned, including custom or personalised pieces, diamonds sourced specifically for your order, semi-mounts and empty settings, custom-cut stones, and rush-order fees. Certified diamonds must come back with their grading report; a $250 fee applies if it is missing, and a $75 fee applies if a complimentary ring sizer is not returned. Once a ring has been resized by anyone, it is no longer returnable.
Follow the return instructions we give you. Where you arrange return shipping yourself — including international returns — risk of loss stays with you until the piece reaches us, so please insure it. Read the full policy before ordering.
10. Shipping, title and risk
Our Shipping Policy forms part of these Terms. All orders are insured from our workshop until they are signed for, and require a signature on delivery. For high-value shipments the courier may also ask for government-issued photo ID. We do not ship to PO boxes or APO/FPO addresses.
Title and risk of loss pass to you when the courier records the parcel as delivered to the address you gave us. After that point the piece is yours to look after — we are not responsible for loss, theft or damage once delivery has been recorded, and we recommend arranging your own jewellery insurance. Please give us an address where someone can receive it.
For international orders, duties, VAT and import taxes are payable by you directly to your local customs authority and are not refundable. We are not liable for delays caused by customs or government holds. Where a parcel cannot be delivered, our Refund Policy sets out what happens next.
11. Warranty, resizing and repairs
Our warranty. Our Manufacturing Warranty page forms part of these Terms. In summary, we warrant every piece to be free from manufacturing defects in materials and workmanship at delivery, and we guarantee that the lab-grown diamonds we sell will retain their original colour and clarity for life — under normal use they will not cloud, fade or change colour. Where a covered issue is found, we repair or replace at no cost.
The warranty does not cover normal wear — scratches, dents, deformation, prong thinning or bending — nor discolouration from chemicals, lotions, pools or hot tubs, accidents, mishandling, improper cleaning, or work by any jeweller we have not authorised. Having a piece altered, resized or serviced elsewhere ends the warranty on the affected work. We recommend personal jewellery insurance for loss, theft or physical damage.
Resizing and repairs. Our Free Ring Resizing page forms part of these Terms and sets out eligibility and limits. Resizing and repair carry an inherent risk of stress to a setting or stone; we take reasonable precautions but cannot eliminate that risk. Some designs cannot be resized safely, and a ring that cannot be resized may also be unsuitable for return within the return period.
Customer-supplied stones. Where we set a stone or material you provide, you accept the risks of doing so. We are not responsible for loss, damage or breakage to customer-supplied stones during handling, setting, resizing or repair, and settings made around them are sold as-is with no setting warranty.
Metals and sensitivities. Our pieces use fine metals and alloys which may contain nickel. Please check suitability if you have a metal sensitivity; we are not liable for allergic reactions.
12. Third-party sites and services
The Services rely on third parties — among them Shopify, our payment providers, carriers, review tools and grading laboratories — and may link to sites or make tools available that we do not control. We make no warranties about them and are not responsible for loss arising from their use. Your use of them is at your own risk and is governed by their terms and privacy policies. A link or tool is not an endorsement.
13. Disclaimers
We use reasonable efforts to keep the site accurate and current, but we make no warranty as to the accuracy, completeness, timeliness or reliability of information on it, including availability and measurements.
EXCEPT FOR THE MANUFACTURING WARRANTY AND THE LIFETIME COLOUR AND CLARITY GUARANTEE SET OUT IN SECTION 11, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, AND WE DISCLAIM ALL OTHER WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the site will be uninterrupted, error-free, secure, or free from viruses.
Nothing here limits rights you have under law that cannot be limited.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of goodwill, arising from your use of or inability to use the Services — whether the claim is framed in contract, tort, negligence, strict liability or otherwise, and even if we were told such damage was possible.
To the fullest extent permitted by law, we are also not liable for emotional distress or anxiety, for claims arising from a missed deadline, delayed delivery or personal occasion, or for subjective dissatisfaction where a piece is as described. Your remedy is repair, replacement or refund as set out in these Terms and our policies.
To the fullest extent permitted by law, our total liability for any claim connected with the Services or these Terms will not exceed the amount you paid us in the six months before the event giving rise to it.
Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or anything else that cannot lawfully be limited. Some jurisdictions do not allow these limits; where that is so, they apply as far as the law allows.
15. Indemnification
You agree to indemnify, defend and hold harmless Margot Vane and its officers, employees and suppliers against claims, losses, costs and reasonable legal fees arising from your use of the Services, anything you submit to us, your breach of these Terms, or your infringement of someone else's rights.
We may take over the defence of any such matter, in which case you will cooperate with us. You may not settle a claim covered by this section without our written consent.
16. Events outside our control
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural events, industrial action, war, epidemic, courier delays or failure, supply-chain disruption, tariffs or changes to import rules, government or customs action, or failure of payment or hosting infrastructure. Where such an event affects your order, we will contact you, and you may cancel and receive a refund for anything not yet shipped.
17. Disputes and binding arbitration
Talk to us first. Most problems are solved quickly by emailing care@margotvane.com. Please give us 30 days to put things right before starting formal proceedings. We will do the same before bringing a claim against you.
Binding arbitration. If we cannot resolve it, you and Margot Vane agree that any dispute, claim or controversy arising out of or relating to these Terms, the Services, or any purchase or dealing with us will be resolved by final and binding arbitration rather than in court, administered by JAMS under its rules in effect at the time and applicable to the amount in dispute, including the JAMS Mass Arbitration Procedures and Guidelines where they apply. The Federal Arbitration Act governs this section. You and we both give up the right to a jury.
Where, and how. Arbitration will be seated in Collin County, Texas, before a single arbitrator appointed under the JAMS rules. Claims of $10,000 or less will be decided on the documents alone unless you ask for a hearing or the arbitrator decides one is needed, so that a smaller claim does not cost more to bring than it is worth.
Small claims. Either of us may instead bring an individual claim in small-claims court where it qualifies.
No class actions. Claims may be brought only in an individual capacity, and not as a plaintiff or member of any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Opt out.
Who decides whether this section applies.
Mass filings.
If part of this fails. If any part of this section is unenforceable, the rest continues to apply — except that if the class-action waiver above is found unenforceable, this whole arbitration section falls away and disputes proceed in court.
Changes. We may change this section on 30 days' notice, and any change applies only to disputes arising after the notice takes effect.
Nothing here prevents either of us asking a court for urgent interim relief in support of arbitration.
18. Governing law
These Terms, your use of the Website and Services, and any dispute arising out of them are governed by the laws of the State of Texas, without regard to conflict-of-law rules that would apply another jurisdiction's law.
Subject to section 17, any dispute not resolved by arbitration and not brought in small-claims court will be resolved exclusively in the state or federal courts located in Collin County, Texas. Both of us consent to the personal jurisdiction and venue of those courts and will not argue that they are an inconvenient forum.
19. General
Ending access. We may suspend or end your access to the Services, remove content you have submitted, or close your account, including for breach of these Terms or unlawful conduct. Sections that by their nature should survive — including sections 6, 9, 11, 13, 14, 15, 17 and 18 — continue to apply afterwards.
Time limits.
Everything else. These Terms, with the policies referred to in them, are the entire agreement between you and us about the Services and replace any earlier understanding on the same subject. If any provision is unenforceable, the rest continues. Our not enforcing a provision, or delaying, is not a waiver of it. Section headings are for convenience and have no legal effect. Our licensors and suppliers may rely on the protections given to us in these Terms. These Terms bind our respective successors and permitted assigns; you may not assign your rights without our written consent, and we may assign ours in connection with a sale or reorganisation of the business. Nothing here creates a partnership, agency or employment relationship.
20. Contact
Questions about these Terms, or about anything else, go to our client care team — we would always rather hear from you before a problem becomes a dispute.
